The owner respects your privacy and processes your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD). This policy explains clearly what data we process, for what purposes, on what legal basis, and what rights you have.

1. Data Controller
Controller: Moisés Vicens i Francés, lawyer.
NIF: 74012797Q. Address: Calle Corbeta 3, Entlo. (MV Abogados), 03710 Calpe (Alicante), España.
Data protection contact e-mail: mvicensf@mvabogados.net.
Given the scale and nature of the activity, the appointment of a Data Protection Officer is not mandatory. Any queries regarding your data may be directed to the e-mail address above.
2. What Data We Process and Where It Comes From
Contact details you provide via the contact form: name, e-mail address, telephone number (optional), and the content of your message. Also any data you provide by e-mail or messaging applications if you choose to contact us through those channels.
Browsing data: this website uses aggregate and anonymous audience analytics that do not identify you personally (see the Cookies Policy).
We do not process special categories of data (health, ideology, etc.) unless you voluntarily provide them when describing your case; we recommend that you do not include particularly sensitive data in an initial contact.
3. Purposes
To handle and respond to your enquiry through the contact channels.
Where applicable, to assess and, if appropriate, provide the requested legal service and manage the professional relationship.
To ensure the security of the website and prevent automated or fraudulent form submissions.
To obtain anonymous audience measurement data to understand how the website is used.
4. Legal Basis for Each Processing Activity
Response to your enquiry: your consent, given when submitting the form, and the implementation of pre-contractual measures at your request (Art. 6(1)(a) and 6(1)(b) GDPR).
Provision of legal services: performance of the professional engagement and compliance with associated legal obligations (Art. 6(1)(b) and 6(1)(c)).
Website security and prevention of abuse: the legitimate interest of the controller in protecting the website (Art. 6(1)(f)).
Anonymous audience measurement: legitimate interest in understanding, in a non-intrusive manner, how the website is used (Art. 6(1)(f)). As this is anonymous, it does not allow you to be identified.
Compliance with legal obligations, including anti-money laundering legislation where applicable (Art. 6(1)(c)).
5. How Long We Retain Your Data
If your enquiry does not lead to a professional engagement, we will retain your data for a maximum of one year from the last contact, unless you request erasure before that time.
If the enquiry leads to an engagement, we will retain the data for the duration of the professional relationship and, once concluded, for the applicable statutory limitation periods for any legal actions that may arise, duly restricted.
In matters where the owner acts as an obliged entity under Law 10/2010 on the prevention of money laundering and terrorist financing — including, amongst others, property transactions and management of client funds — documentation shall be retained for ten years, as required by Article 25 of that law.
6. Recipients and Data Processors
We do not transfer your data to third parties, except where required by law or ordered by a competent authority.
To provide the service, we rely on suppliers acting as data processors under contract and with guarantees in accordance with Article 28 GDPR: website hosting and anonymous analytics are provided by Vercel; form e-mail delivery is provided by Resend; and anti-spam protection for the form is provided by Cloudflare (Turnstile).
In the context of a professional engagement, your data may be communicated to notaries, registries, the Tax Agency, banking institutions, or other bodies where necessary to handle your matter, always in your interest and on your behalf.
7. International Transfers
Some of the technology providers listed (for example, hosting and e-mail delivery services) may process data on servers located outside the European Economic Area, in particular in the United States.
In such cases, those transfers are covered by the safeguards provided for in the GDPR, such as the standard contractual clauses approved by the European Commission or, where applicable, recognised adequacy frameworks. You may request further information about these safeguards at the contact e-mail address.
8. Your Rights
You may exercise at any time your rights of access, rectification, erasure (right to be forgotten), objection, restriction of processing, and data portability.
To do so, please write to mvicensf@mvabogados.net stating the right you wish to exercise. We may ask you to verify your identity.
Where processing is based on your consent, you may withdraw it at any time, without affecting the lawfulness of processing carried out prior to its withdrawal.
9. Complaint to the Supervisory Authority
If you consider that the processing of your data does not comply with the applicable legislation, you have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) through its online portal at www.aepd.es. We would, however, appreciate the opportunity to address the matter before you do so.
10. Security
We apply appropriate technical and organisational measures to protect your data against loss, misuse, or unauthorised access, taking into account the state of the art and the risks associated with the processing.
The contact form incorporates anti-spam protection (Cloudflare Turnstile), which does not use tracking cookies.
11. Automated Decision-Making and Profiling
We do not make automated decisions that produce legal effects on you, nor do we carry out profiling using your data.
12. Third-Party Data and Minors
If you provide us with data relating to third parties (for example, other heirs or parties involved in a transaction), you undertake to have informed them of the processing and to have obtained their consent where required.
This website is not directed at minors. If you are a minor, please do not provide personal data without the consent of your legal guardians.
13. Changes to This Policy
This policy may be updated to reflect regulatory changes or changes to the services. The current version shall always be the one published on this website, with its date of last update.
